1. Information OTB collects and how it is used

OTB collects certain information to enable you to take full advantage of the OTB System when you register at our site, interact with Institutions, participate in our contests, surveys, promotions, or activities, or otherwise communicate with us. If you choose, you can visit the OTB website without providing us with any information about yourself. OTB collects both personally identifiable and non-personally identifiable information from users of its website and mobile apps.

Personally Identifiable Information. If you are an Athlete, when you register to use the OTB Service, we require you to give us contact information (such as your name, e-mail address, and physical address) and demographic information (such as your age and gender). Also, if you choose to interact with an Institution, we may provide information regarding your current location to your selected Institution. If you are an Institution, when you register to use the OTB Service, we require you to give us contact information (such as your name, e-mail address, telephone number and the physical address(es) of the place(s) of business that you are registering for use with the OTB Service), your hours of business, whether you take credit cards and what type, and other commercially relevant information. Also, we will require your credit card information.

We may require additional information for specific promotions or contests running on our site.

The Athlete contact information we collect is utilized to complete your personal Athlete profile and to send you, if you so choose, information about our company, newsletters, promotional materials, and information from our institutions. We use the information Institutions provide to let Athletes know important facts about your Institution, such as general information surrounding rosters and staff, athletic and university facilities tours, the location(s) of athletic and university facilities, as well as ancillary information including schedule, notable alumni, and Institution history, among others.

We may also use the information we collect, in combination with outside records, to notify you about important changes to the website, new OTB services and products, and special offers and information we think you'll find valuable.

We may send you information in conjunction with third-party partners that we think is relevant to your interests.

We use information gathered when you elect to interact with an Institution to enable the Institution to process your interaction, to enable the Institution to timely interact with your interaction, to notify you of your interaction status, and to enable Institutions to understand various metrics regarding the effectiveness of their responses. An Institution customer care representative or a representative of a third party contractor may contact you in order to interact with you or to provide information you requested.

Non-personally Identifiable Information. We may collect certain non-personally identifiable information about you when you visit our site, such as the type of web browser you are using (e.g., Internet Explorer, Firefox, Safari), the type of PC operating system you are using (e.g. Apple OS X, Microsoft Windows, Ubuntu), the type of mobile operating system you are using (e.g. Android, iOS), the referring site from which you came (e.g., a partner site), and the domain name of your internet service provider (e.g., Comcast, Earthlink, Spectrum).

We use the non-personally identifiable information that we collect in the aggregate to improve the design and content of our site and mobile apps. We also use this information to analyze site and mobile app usage.

2. Disclosure of information to outside parties

To process your information, we will need to share some of the personally identifiable information you provided (e.g., contact information, your current location, and information you provide) with Institutions. OTB will not allow access nor sell access to your personally identifiable or non-personally identifiable information to third party analytics firms. However, OTB retains the exclusive right to use the personally and non-personally identifiable information we collect for OTB-related business efforts – existing platform feature enhancement and development.

If you choose to receive promotions, newsletters, and/or other types of correspondence from us, the correspondence that you receive will originate from OTB or from our affiliated Institutions and your personally identifiable information will continue to be solely maintained by OTB.

If you registered with OTB through a third-party website or if you registered with a third-party website through OTB, we may need to report certain information to that website, as is necessary. If you come to the OTB System via a co-branded partner and transact business with us, the information you provide may be collected and used by OTB, as well as by the co-branded partner from which you came. OTB is not responsible for the use that the co-branded partner makes of this information.

To help you identify when you are on the OTB website or using a OTB-branded mobile app, we place our logo in the upper left corner to indicate that you are interacting with OTB.

OTB may be obligated to disclose personally identifiable information to law enforcement or agencies, even though such agencies may not comply with the terms of our privacy policy. OTB will disclose information to such agencies in response to legal process or when we believe in good faith that the law requires it, for example, in response to a court order, subpoena, or a law enforcement agency's request.

Finally, OTB may provide aggregate statistics about our customers, sales, traffic patterns, and related website and mobile app information to Merchant/Service Providers, partners, or to the press. Aggregate statistics contain only non-personally identifiable information.

3. Information OTB's partners collect

Our website and mobile apps contains links to other websites whose information privacy practices may be different than ours. You should consult the other sites' privacy policies, as we have no control over information that you may submit to them or that third parties collect on those sites.

We may offer promotions or content that is sponsored by, or co-branded with, identified third parties. By virtue of these relationships, these third parties may obtain personally identifiable information that you submit. OTB has no control over the third party's use of this information.

4. OTB's use of cookies

OTB’s website uses cookies, a technology that stores small pieces of information on your hard drive, to personalize content and keep track of your interactions during your visit. Each time your browser visits a website, the site sends all cookies relevant to that website; cookies are used to maintain a session between you and the web server.

5. Commitment to the security of your information

The personally identifiable information you provide and we collect is stored within databases that we control directly or through our Service Providers. As we deem appropriate, we use security measures consistent with industry standards, such as firewalls, to protect your personally identifiable information. We also use industry standard encryption technology to protect credit card and password information. However, since no security system is impenetrable, we cannot guarantee the security of our databases, nor can we guarantee that information you supply will not be intercepted while being transmitted to us over the Internet.

Your information may be transferred to, and maintained on, computers located outside of your state, province, or country where the privacy laws may not be as protective as those where you live. If you are located outside the United States and choose to provide information to us, please be aware that we will transfer personally identifiable information to the United States and process and store it there. By submitting your personally identifiable to us, you consent to having your personal data transferred to, processed, and stored in the United States.

OTB will assign you a user ID and a password when you register. Your user ID and password may only be used by you and: (a) The members of your household if you are an Athlete; and/or, (b) Your authorized agents if you are an Institution. You are solely responsible for maintaining and protecting the confidentiality of your user ID and password, and are solely and fully responsible for all activities on the Website undertaken by those using your user ID and password.

6. How to update/change your preferences

OTB may send communications, promotional information, and/or newsletters to our registrants. You can choose to not receive communications from us. To review and update the personally identifiable and other account information that we collect and maintain about you, including options for communications, news, and special offers, either: 1) Log-in to the OTB website and visit your "User Settings" webpage where you can update certain information (such as your user ID and password as well as notification preferences), or 2) Depending upon the email provider that OTB elects to use, select unsubscribe to update your communication preferences accordingly. You cannot, however, unsubscribe from receiving certain emails, such as account status and billing related emails.

7. Changes to privacy policy

If we materially change our privacy policy, we will post changes on this page so that you are always aware of what information we collect, how we use it, and under what circumstances we disclose it. We will also post a notice on our homepage that our privacy policy has been changed.
